Terms and Conditions
1. Basic Provisions
These general terms and conditions (“Terms”) are issued in accordance with § 1751 (1) of Act No. 89/2012 Coll., the Civil Code, as amended (“Civil Code”).

(hereinafter referred to as the “Seller”)
1.2. These terms and conditions regulate the mutual rights and obligations of the contracting parties arising in connection with or based on a purchase agreement (hereinafter referred to as the “Purchase Agreement”) concluded between the Seller and another natural person (hereinafter referred to as the “Buyer”) via the online store at http://www.carevna.cz(hereinafter referred to as the “Online Store”).
1.3. The Terms and Purchase Agreement are primarily drawn up in Czech unless the parties agree otherwise. The contractual relationship is governed by Czech law in its effective version.
1.4. These Terms define the relationship and rights and obligations exclusively between the Seller and the Buyer – a natural person acting outside the scope of their business or independent professional activity.
1.5. The Seller may change or supplement these Terms based on § 1752 of Act No. 89/2012 Coll., the Civil Code. Changes will be announced via the Seller’s website at http://www.carevna.cz with an effective date and an option to review previous versions. The other party has the right to reject changes in the case of long-term agreements for repeated performance and may terminate the agreement within one month from the effective date of the new Terms.
Definitions

Price – The amount payable for goods.

Shipping Price – The amount payable for delivery, including packaging costs.

Total Price – The sum of the Price and Shipping Price.

VAT – Value-added tax according to applicable legal regulations.

Invoice – A tax document issued in accordance with VAT law on the Total Price.

Order – A binding offer to conclude a Purchase Agreement.

User Account – An account created based on the Buyer’s provided information, allowing storage of entered data and order history.

You – The person making a purchase in our Online Store, legally referred to as the Buyer.

Goods – Any items available for purchase in the Online Store.
1.6. These Terms do not apply when the person intending to purchase goods from the Seller is a legal entity or a person ordering goods as part of their business or independent professional activity.
1.7. If any part of the Terms contradicts an agreement made during the purchasing process, that specific agreement will take precedence.
1.8. The provisions of these Terms are an integral part of the Purchase Agreement. The Agreement and Terms are drawn up in Czech. The Seller may unilaterally modify or supplement them, but such changes do not affect rights and obligations established under previous versions.
1.9. Communication is primarily conducted remotely. Consequently, the Seller utilizes remote communication tools that allow both parties to agree without physical presence, meaning the agreement is concluded via the Online Store’s web interface at www.carevna.cz.
3. Price and Payment Methods
3.1. The Buyer may pay the Price and applicable Shipping costs via the following methods:

Bank Transfer to the Seller’s account no. 2501877934/2010 at FIO Bank.

Online Payment using Apple Pay, Google Pay, GoPay.

Cash on Delivery in cash upon receipt of the goods.

Cash or Card at a designated pick-up location (Zásilkovna).

Cash Payment at the Seller’s business premises: Na Jánské 25, Ostrava 710 00.
3.2. The Buyer must pay the purchase price and any associated packaging and delivery costs unless stated otherwise.
3.3. In the case of cash or cash-on-delivery payments, the Price is payable upon receipt. For bank transfers, the Price is due within the specified period after concluding the Purchase Agreement.
3.4. For bank transfers, the Buyer must include the specified variable symbol in the payment. The payment obligation is fulfilled once the required amount is credited to the Seller’s account.
3.5. Under § 1820 (1)(q) of the Civil Code, the Seller does not require advance payment unless necessary for the nature of the goods and agreed with the Buyer.
3.6. Any discounts or price reductions cannot be combined unless decided otherwise by the Seller. Buyers will be informed of applicable discounts before confirming an order.
3.7. The Seller issues an invoice upon payment confirmation, which is sent via email or provided physically at pickup.
4. Delivery of Goods
4.1. Shipping costs are stated in the Order and confirmed by the Seller.
4.2. The Buyer must accept goods at the specified delivery address. Failure to do so may result in the return of goods to the Seller. In such cases, the Buyer will be responsible for repeated shipping costs.
4.3. Upon receiving the goods, the Buyer must inspect them for damage. If damaged, the Buyer must inform the carrier immediately and refuse the delivery.
4.4. Ownership and liability for the goods transfer to the Buyer upon payment and receipt.
4.5. Goods are delivered via:

Courier services (GLS, Zásilkovna).

Personal pickup at the Seller’s location.
4.6. Personal pickup is free of charge.
4.7. Orders are typically handed to the courier within two business days.
4.8. Buyers choosing in-store pickup must collect their goods within five days.
4.9. Digital content is provided with compatibility requirements specified. The Buyer agrees that purchasing digital content nullifies the right to withdraw under § 1837(l) of the Civil Code.
4.10. The Seller reserves the right to adjust prices using an automated pricing system based on a pre-defined algorithm.
4.11. Goods return policies comply with applicable consumer protection laws.
Final Provisions

These Terms are governed by Czech law. The Seller is not liable for failures due to force majeure or Online Store outages.

If a foreign entity is involved, Czech law will apply, respecting international regulations.

The Seller reserves the right to modify these Terms, but such changes will not affect prior agreements.

These Terms and Conditions take effect on December 14, 2024.
